Trademark Register is the official public database containing data on all filed trademark applications, as well as information on registered and expired trademarks. It is an official source of information that you can use to verify whether a particular name, logo or slogan is already protected by a trademark, who owns it, for which goods and services it is registered, and whether it is currently valid. Based on which office maintains the trademark register, you can determine the territory in which the trademark is registered.
The registers are maintained primarily by national offices – in the territory of the Slovak Republic, this is the Industrial Property Office of the Slovak Republic, EUIPO European office (European Union Intellectual Property Office), which maintains records of European EU TM trademarks with territorial effect in the Member States of the European Union, and at the global level they are administered by WIPO (World Intellectual Property Office) as part of the Madrid System.
This register is important for businesses, individuals, marketing experts and agencies involved in creating identities (naming and branding), as well as for potential investors or buyers of companies that own the trademark for their brand, and for us lawyers – attorneys – because it makes it possible to quickly determine and identify whether your desired planned brand is available for registration as a trademark or whether your competitor is already using it in the same or a similar form, and whether there is a risk of infringing another entity’s rights.
